Cohabitation Rights

One of the unmarried misconceptions people have is that they believe they have the same rights as those who are married. There are certain areas you need to consider:

Finances

  • Who owns the property you live in?
  • Have you made any contributions to the property?
  • What did you intend to share when you bought the property or moved in together?
  • The law regarding property in Trusts of Land and Appointment of Trustees Act.

Children

  • A father who is not married at the time of a child's birth can only acquire parental responsibility if they are named on the birth certificate after 1st December 2003 or by the parents entering into a parental Responsibility Agreement.
  • As a main carer, you may wish to consider making an application under Schedule 1 of the Children Act 1989, which deals with financial provision on behalf of children of a relationship.
